Spouse Maintenance
The breakdown of a marriage can have serious financial ramifications, especially on the more vulnerable party. Under the Family Law Act 1975 (Cth), spouses have the right to support each other if one party can demonstrate they have a need of support need and the other party has the capacity to provide that financial support. Although spouse maintenance is a complex outcome to achieve, York Law has the expertise to make a difference.
For those without adequate income to support themselves, especially individuals who were not the primary earners, spousal maintenance can be a crucial source of support. It’s important to seek legal advice swiftly, to avoid unnecessary financial hardship. Spouse maintenance can apply to married or de facto relationship and can be either a lump sum or regular payments for an agreed duration.
A landmark spouse maintenance case
Our founder and Managing Director, Nabil Wahhab helped his client achieve the largest lump sum maintenance order made by the Family Court in Australia – the husband of his client was ordered to pay the wife the sum of $3.75million. Whilst the payment was ultimately the subject of a small reduction following the Appeal decision, this case is a reminder of how spouse maintenance can be effective in providing some compensation to a spouse that has been out of the workforce and devoted their time in raising the parties’ children.
“Although spouse maintenance is a complex outcome to achieve, York Law has the expertise to make a difference.”
